    It is an argument of convenience. It saves the VA a lot of money to deny us benefits. The employees pretend to be ignorant of the situation but they all know what is really going on.

    My file was sent from Reno NV, to Jackson MS. I’m zero%, but approved for stress. I filed for several claims Radiation Exposed Veteran, and specifically written in 38 CFR I was in Enewetak Atoll during the presumptive period. Through several groups not VA related was told DTRA still denies allowing Radiation exposed veteran. Can you comment on this? I’ve been trying for over 40 years for help.

    I've had tinnitus since 2004 I never filed for any disability up until 3 years ago when I could absolutely not work anymore due to PTSD. I have a big record of depression very bad anxiety no matter what I tell the doctors they never do anything? Does anyone know a remedy for sleeping when your head is ringing so bad ?

    nice to know. Just got 0% disability as a GERD secondary for tinnitus, even having taken meds to control it for the last ten years. Just to top that off, denied on a heart claim after open heart surgery (quad bypass). Reasoning: nothing in my military records to indicate issues despite patrolling the East German and (then) Czechoslovakian Borders armed and ready for over four years (diagnosed with PTSD btw, non nexis). Something is very wrong with the VA nowadays, and its not just hurting me, but also thousands of other guys and gals who served in my era; and on the Grenz or DMZ.

    ADHD is also genetic but can be made worse by toxic chemicals used in the military. Toxic water due to PFAS and PFOA can also cause ADHD, Alzheimers, and dementia.

    Good info but as several commenters have noted it is very far from an automatic 70% in real world experience. The VA can and does ignore its own rules, regulations and case law. I encourage anyone pursuing an MH claim to read up on Bankhead v. Shulkin (2017). It's a CAVC case that educated the VA on what they were doing wrong in evaluating SI under the 70% criteria. I received my initial rating in 2021, four years after Bankhead. Yet the C&P examiner, the initial rater, and whoever handled my HLR must have been utterly ignorant of this case and its guidelines (unfortunately I was too!). If they did know about it then they failed to give a veteran the benefit of the doubt as required. It took a very difficult and detailed Supplemental to get them to do the right thing. Today, seven years after Bankhead the M21 Manual still makes no mention of the case or its guidelines. This suggests to me that they are still ignorant and continue to get this wrong.

    Age is not good to service connected disabilities. They get much worse and reduce your life expectancy. Many die without getting any benefits.

    I guess I should be glad I've been able to get my benefits on my own. I contacted your firm but your firm wasn't able to take my case. Your firm referred to others but they're wouldn't take my case either. I thought/ think my Effective Date should be earlier than the date approved,but after hearing all the arguments. I'm probably lucky to have what I have.

    I have requested my see file 18 months later I don’t have it. I’ve requested documentation from different VA hospitals never got it had to go into my CMP without any documentation whatsoever because the VA refuses to help veterans they don’t understand the duty to exist most them can’t even spell. I think they they get these people off the street who sleep at home and if the phone rings, they try to answer, but they don’t know what they’re talking about but they do know how to disrespect Veterans and hang up on Veterans, and then when you talk to their supervisors or supervisors, hang up on you. they don’t even have a clue what they’re doing that the VA system is just like the VSO they have no clue what they’re doing. The only ones that can help you file a claim is the lawyers out there charging too much money for to file a claim but 60 or 70% of something is better than nothing which is what you get from the VA and VSO OFFICERS..

    I went to see a va shrink to request that i have a comeptency exam he said that the va will decline such request he called me back and told me that VBA denied such request still looking for a shrink that can conduct such exams the c and p exam was half baked anyway as usal and yet when changing a new feduicary I was still found incompentent i always pay my bills on time or in a timely matter unless there are circumstances beyond my control anyway once I find a shrink to conduct such exams if found to be compeonet then and the va shoots it down I will sue the va this is a stigmaticia the va puts on its vets I plan on breaking away from the va like breaking away from them who needs them the va is a bloody joke esp the medical side of the coin

    I was just diagnosed with IBM through genetic blood test by a Neuro Specialist. I was never in the military. I am 53 and symptoms started after my husband died in 2018 but really were noticeable after a car accident in 2021. I already have breathing issues from a partially paralyzed diaphragm from being overweight for years. Although during my husbands bvFTD I lost a lot of my weight from caring for him. I am having balance and walking problems now and am reluctant to start using my rollator walker. I live in central Indiana and would like to find a support group here that can help me through some things and with questions about the disease.

    I have a c&p scheduled for an initial tbi dbq. Optumserve said it's a neuro exam. I do have neurological symptoms listed on my claim, but never diagnosed with a tbi. Optimserve says I need to do the dbq BEFORE they schedule the appointment. Should I do this dbq now, and what should I put?? I'm totally lost with this. My claim is pretty complex with 14 things listed. It says 'get started' on my profile. Ive never had this happen before.

    I am GW Veteran and have been affected by symptoms related to GWI before I separated from service in Oct 1991. Recent research from the last 5 years states that GWI is a neurological illness from the results of multiple neuro toxin exposures. The most prominent exposures are pesticide use and chemical nerve agent sarin gas. These exposures caused neuroinflammation and autonomic dysfunction primarily in the parasympathetic nervous system. Exposure also caused direct damage to veterans in the form of cancers, respiratory illness, skin conditions and some organ damage. Neuroinflammation caused dysfunction in veterans CNS which caused numerous other conditions like immuno deficiency, optic neuropathy, even some tinnitus conditions. PNS dysfunction is the source of most of the chronic illnesses, conditions and symptoms GW veterans are experiencing. All this research was either fully or partially funded by US government agencies. Just in the last two years doctors inside and outside of VHA are publicly saying GW veterans are suffering from the affects of chronic neuroinflammation and autonomic dysfunction. More awareness is still needed to bring these new research results to the forefront so that GW veterans can finally receive the proper medical care and compensation they deserve and most importantly they have earned.

    Thanks H&P another very informative video. The truth is Gulf War illnesses have really messed up allot of veterans. But the lack of training both in VBA and third party C&P contractors has created a perpetual cycle of unwarranted delays, denials, and deaths. This really needs to be addressed at NOVA, hopefully then the VA will listen. Better training needs to happen to correct this unjust treatment our Gulf War veterans are suffering from.

    My question is; why do I have to be fat, unemployed, broke with mental health issues to be taken seriously by any doctor both VA or civilian? I’ve been in chronic pain for over a decade but I like food and electricity in my house. I walk and do resistance exercises to try to stay in shape, eat healthy with no inflammatory foods. I do not have any PTSD, depression or anxiety. Imagine your worse day after a total body gym workout and that’s what I feel like everyday.

    When I was getting separated they told me to file and they said I had up to a year to file any conditions that come up. I told them I was having sharp lower back pain and they denied it and said there was no evidence for my claim, I get there was no evidence because this was my first time telling them, so what’s the point in saying you can file any conditions up to a year after being separated if it’s automatically denied

      Great point, and what you're saying makes a lot of sense. Unfortunately, the communication that you appear to have received was confusing. How long have you been out of the military? What should have been better explained to you was that you have up to one year to submit claims for relevant medical stuff that you were previously diagnosed and/or treated for. In addition, you can submit for medical conditions that you are newly diagnosed and treated for up to one year after separating from military service. In short, you have up to a year to "create/build" relevant medical evidence that aligns with VA/VBA rules and procedures. If you are still within the one year time frame, go get diagnosed and teated at the VA, a civilian doctor, or sick call (if you're a drilling reservist), then "create/build" relevant medical evidence and submit the claims. I hope this helps, and good luck!

    I was denied by the VA regarding my breathing issues due to severe exposure to asbestos while serving in the U.S. Navy. USS IWO JIMA LPH-2 from September 1977 to Jan 1981. I also was onboard the USS RANGER CV FROM 1985 TO 1987. I requested for my military records, Lo, and Behold! they did not include my USS IWO JIMA LPH-2 records. The ship was dry dock in Portsmouth VA when I reported for duty. I was not even designated yet as an E-3. They the VA denied my claim stating since I was only a Aviation Storekeeper and did not have any record of diagnosis is their basis for denial. I have COPD and Asthma with constant breathing problem. I am sure I am not the only one with these issues.
